Terms and Conditions
Before registering with NAKID (No, Adult Kickball Isn't
Dumb), using the PLAYNAKID.com web site, using any other web site owned and operated
by NAKID, or using any NAKID products or services, you must review the following terms
and conditions. These terms and conditions explain NAKID’s obligations to you, your
obligations to NAKID when you register, and will constitute a binding contract between
you and NAKID.
I. PRODUCTS/SERVICES PROVIDED
As a part of registering with NAKID and paying your
outdoor kickball fee, you will be offered or given the following items:
- A short-sleeve team t-shirt
- An invitation to 3 FREE seasonal parties
- Placement on a team
- An open invitation to all official NAKID events and activities
- A regular (often weekly) newsletter
Upon registration, you agree to pay the
registration fee, agree and affirm that you are at least 21 years of age,
have health insurance, and understand that there are risks of injury
associated with any recreational activity, including kickball, as well
as health risks to excessive consumption of alcohol.
You also understand that, as part of a
team, everyone else is depending upon you to show up and play on a regular
basis. If you fail to show for three (3) consecutive weeks of play, you
may be replaced on the roster at the team captains' discretion.
II. KICKBALL AND SOFTBALL RULES
The NAKID Rules for kickball for each
season is available via the kickball page.
III. FLIP CUP RULES
Standard flipcup rules apply when playing, however official games require
6 teammates from each team.
IV. CHARGES FOR PRODUCTS/SERVICES
Upon registering to participate in any NAKID
events, you agree to a registration fee, whose use will be to pay, at least
in part for some of the events.
The spring season currently runs from or around April 1, 2008 through June
2008. Registration costs $52 for one team and $5 less for each subsequent team
you join. Registration costs $62 for one team and $114 for two. There are no
refunds.
Registration during the Winter 2007-2008 season is
for the Winter 2007-2008 season only.
V. COPYRIGHT AND OTHER RIGHTS
All content, images, scripts, and other media
on PLAYNAKID.com are copyrighted to NAKID, unless explicitly stated otherwise.
You may provide information communicated or
expressed via any medium (i.e. verbal communication, physical hand gestures
and communication, hand written, electronically written) by you during any
sporting (Kickball and Softball) events, social events, or written on the message boards
(with proboards.com). If you provide such information, you authorize NAKID
a royalty-free, perpetual, irrevocable, non-exclusive, world-wide, right
and license to reproduce, publish, distribute, perform and display such
material (in whole or in part) at its sole discretion.
VI. NO WARRANTY
There are risks of injury when playing kickball, softball, bocce, or
delete excessive consumption of alcohol. You agree that your participation
or presence at all NAKID events, including, but not limited to kickball,
bocce, softball, flip cup, and social events is at your own risk and you
accept full liability in the even of injury.
All products and services provides by or
through NAKID is provided on an "as is" and "as available" basis without
warranties of any kind, either express or implied, unless such warranties
are legally incapable of exclusion.
Except to the extent that such disclaimers
are expressly prohibited by law, NAKID disclaims any and all loss, damage,
or liability arising out of or relating to your participation or presence
in all NAKID activities.
Your rights and NAKID's responsibilities are
limited to the warranties that are expressed in these written terms and
conditions. You may not rely on oral or written information or advice given
by NAKID's volunteers, administrators, directors, employees, agents, authorized
representatives, subcontractors or affiliates to create a warranty or increase
the scope of warranty already established in these terms and conditions.
VII. INDEMNIFICATION
You agree to defend, release, indemnify, and
hold NAKID, its affiliated companies and licensors, and its and their respective
volunteers, administrators, directors, employees, agents, authorized
representatives, and subcontractors harmless from all liabilities, claims and
expenses, including without limitation reasonable attorneys fees, arising from
breach of these terms and conditions.
VIII. TERMINATION OF REGISTRATION
You agree that, notwithstanding anything herein
to the contrary, NAKID may terminate this Agreement for any reason at any time.
You agree that NAKID has the right, but not the
obligation, to delete all program, data, or other files on our computer servers
that are associated with your registration information at the time of termination.
YYou understand and agree that NAKID has the right to suspend your
registration if you are delinquent in payment or if otherwise deemed a
detriment to the league.
